Terms & Conditions

1.1 The following Terms and Conditions, together with the information set out on the Bushido Travel website, will form the contract between you and us for your tour with us. 

1.2 In this contract, a reference to “you” and “your” include the lead-named person on the confirmation invoice (who must be at least 18 years old at the time of booking) and all persons on whose behalf a booking is made. 

1.3 “We” is Bushido Travel Pty Ltd of;

2.0 Definitions

‘Meeting Point’ means the place specified by us (normally the first listed accommodation of the tour), in the tour pack, as the place we will meet and start the tour.

‘Start Date’ means the first date of the tour.

‘Tour’ means a tour organised by Bushido Travel Pty Ltd.

‘Tour Pack’ means whatever documents we send to you in hard, or soft, copy to provide information to you about your tour. 

3.0 Information about your Tour.

3.1 The contract between us comes into existence when you accept the quote and a confirmation invoice which confirms your booking details. You will have undertaken to pay for the tour you have booked, and we will have undertaken to provide you with the tour we describe, on our web site (or as per your tailor-made itinerary) as best we can.

3.2 If you make a booking on behalf of others as well as yourself, we shall take it that you have the authority of each of those other people to enter into that contract and that you and they have agreed to be jointly and severally liable to us. You now accept personal liability for the acceptance and compliance of each of those people, with these contract terms. If we are unable to accept your booking, we will refund your payment to you. 

3.3 For you to make a booking, we require you to accept the official quote and pay a deposit. A confirmation invoice will be sent to you by post, email or accounting website. We may decline your booking for any reason and we do not have to give you that reason. If this happens, we will refund your money, to your advised account, within 14 days. 

4.0 What is included in the price of a Bushido Travel Pty Ltd group tour

4.1 All accommodation, breakfasts and light ‘picnic style’ lunches as stated in the itinerary. 

4.2 All travel throughout the tour region that includes rail, flights, tour buses, local transport and private transport as stated in the itinerary (last minute changes to the itinerary can be made if it is considered beneficial to the group) 

4.3 Selected entry fees as stated in the itinerary. 

4.4 Services of one or more leaders.

4.5 These inclusions are not applicable for tailor-made itineraries. Tailor-made itineraries will list inclusions as per client requirements in the Tailor-made itinerary. 

5.0 What is NOT included in the price of a Bushido Travel Pty Ltd group tour

5.1 Return flights from, and returning to, the nominated meeting point for the tour (first listed hotel). 

5.2 Travel to and from the meeting point. 

5.3 All other costs incurred before arriving at the meeting point and after you return to the departure point. 

5.4 Travel insurance or any other insurance personal to you. 

5.5 Passport and visa costs. 

5.6 Vaccinations and medication, before, during and after the tour. 

5.7 Food and drink over and above what we include in the tour. 

5.8 Personal spending money. 

5.9 Baggage transfers unless indicated on the itinerary. 

5.10 Private transfers not indicated on the itinerary. 

5.11 Taxis unless indicated on the itinerary. 

5.12 Alcohol of any sort.

5.13 These exclusions are not applicable for tailor-made itineraries. Tailor-made itineraries will list exclusions as per client requirements in the Tailor-made itinerary. 

6.0 Payment 

6.1 Payment can be made by direct bank transfer or credit card. 

6.2 The last date for payment of the balance of the cost of your tour will be due to us at least six weeks before the tour start date. We will tell you that last date for payment after we have confirmed our acceptance of your booking. If you do not pay us before the last date for payment, we reserve the right to treat your booking as cancelled. If we do that, you accept that a cancellation fee will be due to us. 

6.3 All payments to us may be made by electronic funds transfer (for which full information will be provided at the time of booking) and payable to ‘Bushido Travel Pty Ltd. We shall take account of your payment on the date it is cleared into our account. You agree that all these provisions are reasonable. 

7.0 Late Bookings 

7.1 Any tours requested less than six weeks prior to the departure date must be accompanied by full payment at the time of booking. 

8.0 Surcharges 

8.1 The prices given on our web site and in our brochure, are calculated at costs current at the time we fixed them. If costs rise or adverse currency exchange rates apply, you agree that we may increase prices at any time to a maximum of 5% of the advertised cost of the Tour. If we do this, we shall tell you the costs which have risen and the percentage by which they have risen. 

8.2 No matter what the increase, we shall not increase the cost less than six weeks before the departure date. If we increase the price of your tour by more than 5%, you are free to cancel. In that circumstance, we will offer another Bushido Travel tour or will return to you all money paid to us.

9.0 Refunds 

9.1 Deposits are non-refundable (see cancellations) but in some cases, may be transferable to another Bushido Travel Tour. All other money paid to Bushido Travel Pty Ltd will be subject to cancellation policies laid out below. 

10.0 Cancellations by you 

10.1 If you cancel your booking either through failure to pay the balance due or for any other reason, we may charge a cancellation fee calculated as follows: 

10.1.1 Up to 60 days before departure: loss of deposit

10.1.2 Less than 42 days before departure: 30% of the tour cost

10.1.3 Between 29 and 42 days before departure 60% of the tour cost

10.1.4 Between 15 and 28 days before departure 80% of the tour cost

10.1.5 Fourteen days or less before departure (or failure to join the tour)100 % of the tour cost.

10.2 The above dates refer to the date that we receive notice of cancellation from you. If circumstances force you to leave the tour early, you will have to bear any additional costs.

10.3 If you are unavoidably prevented from joining the tour, you may transfer your place to another person, providing this person meets any conditions which may apply to the booking and that we are informed of the transfer not less than 28 days prior to the Tour Start Date. The transfer of booking will incur transfer fees, listed by the travel partners providing the service, and will be met by you.

10.4 In any circumstances giving rise to cancellation, we will consider allowing you to transfer the money you have paid to another Bushido Travel Pty Ltd tour you choose. Whether we do so is in our discretion, for which we do not have to give a reason.

11.0 Cancellation by us 

11.1 We reserve the right to cancel any tour, that does not meet the minimum 6 person booking, not less than four weeks prior to departure. In the event of our cancellation, your deposit (and any other payment you may have made to us) will be refunded in full or, if you prefer, transferred to an alternative Bushido Travel Pty Ltd tour. 

11.2 No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make payments to the other party hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party’s control, including, but not limited to, the following force majeure events: 

11.2.1 acts of God, 

11.2.2 a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), epidemic, or pandemic, 

11.2.3 war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, 

11.2.4 government order or law, 

11.2.5 actions, embargoes or blockades in effect on or after the date of this Agreement, 

11.2.6 action by any governmental authority, 

11.2.7 national or regional emergency, 

11.2.8 strikes, labor stoppages or slowdowns or other industrial disturbances, and 

11.2.9 shortage of adequate power or transportation facilities. 

12.0 Changes of Itinerary

12.1 Despite careful planning, it is possible that a site may become inaccessible due to matters outside our control. It is also possible that new information can, or will, in our opinion benefit the tour participants by providing better Bushido Travel Pty Ltd opportunities.

12.2 We may therefore decide to make changes to the itinerary to accommodate changing possibilities. We will tell you of any such change as soon as we decide to make the change.

12.3  If that happens, you may transfer to an alternative tour. If your chosen alternative is of a lower price we will refund the difference. If it is of a higher price, you must pay the difference.

13.0 The Tour 

13.1 Approximately two weeks before the Start Date, we shall send you an invitation to an information session relating to your Tour. This information session can be in person or via video or tele conference and will include: 

13.1.1 Meeting fellow travellers and tour guide(s).

13.1.2 Location of tour meeting point (airport) and time of meeting.

13.1.3 Flight details.

13.1.4 Climate and clothing recommendations. 

13.1.5 Tour location customs and culture. 

13.1.6 Any important details relevant to a particular site that we may visit. 

14.0 Accommodation 

14.1 We will arrange accommodation as close as reasonably possible to the Bushido Travel Pty Ltd sites we visit. Accommodation will be in good quality hotels or lodges. Occasionally it may be necessary to use bed and breakfast accommodation. En-suite facilities will be provided wherever possible. We will discuss your exact accommodation requirements when you have made a booking. 

14.2 We reserve the right to change accommodation to that stated on our website itineraries (see “changes of itinerary”).

14.3 Accommodation is calculated as twin sharing

14.4 Single rooms are available at an extra cost.

14.5 Accommodation in some countries will be of a lower standard than comparable accommodation in Australia. You should expect mattresses and pillows to be firm, shower rooms and toilets are self-contained units and, in some cases, may be shared.

15.0 People with Disabilities 

15.1 While we endeavour to cater for everyone, there are some aspects and segments of our tours that may be inaccessible to people with some disabilities. We will endeavour to highlight these restrictions prior to any booking and will, where we can, offer alternative segments or tours. 

16.0 Baggage restrictions 

16.1 We have to work within the restrictions laid down by any carrier we use. Policies vary from one carrier to another and from time to time. We will tell you the exact allowances and terms after you have made a booking with us. If you have an unusual requirement, perhaps for medical reasons, do contact us and we will try to help you immediately. 

17.0 Travel Insurance 

17.1 It is a condition of booking a Bushido Travel Pty Ltd tour that you take out appropriate travel insurance. You must send us proof of cover when you make payment of the balance due for your tour. 

17.2 We cannot approve the cover you have bought and are not responsible if it is inadequate. 

17.3 Cover should be obtained not only against normal travel risks, but against additional risks appropriate to the destination country. 

17.4 Local road transport insurance may be inadequate, so you should check that your cover includes accidents happening whilst you are a passenger in a vehicle. 

17.5 We advise that you should also check that any valuable optical equipment is covered either in your travel policy or your home contents policy. 

18.0 Passport, Visa and Health Requirement 

18.1 You need to make sure your passport is valid for at least six months after the date of return of your tour.

Please note carefully: 

18.2 Check with your GP what vaccinations and medication you may require and allow time to obtain it. 

19.0 Limitations on our liability 

19.1 We want you to enjoy your tour with Bushido Travel Pty Ltd. We shall do our best to make your tour special for you. Nonetheless, we must make clear the limitations in law. 

We are not liable to you for: 

19.2 any event which happens before you board our transport at the Meeting Point or after you leave our transport at departure

19.3 arising from your failure to reach the meeting point on time, for whatever reason; (though we would do our best to help you in any way we reasonably could);

19.4 the loss of experience (due to reasons beyond our control) you would expect to see or do on your Bushido Travel Pty Ltd tour.

19.5 for any aspect of goods or services you buy or accept other than those arranged by us.medical problems or physical difficulties, even if you have told us about them in advance.

19.6 medical emergencies.

19.7 your own carelessness or negligence in any aspect of your behaviour whilst with us.

19.8 laws, culture and standards of service and behaviour in any country we may visit.

19.9 changes we reasonably make to an itinerary or to accommodation or any other aspect of the management of a tour.

19.10 problems or issues which we could resolve whilst on a tour but which you raise only after your return.

19.11 We, and you, are subject to international conventions, when they apply. This may limit the amount of a claim you may make, against us or anyone else.

Furthermore: 

19.12 The services and features included in your tour are those specified in our web site. If you choose to buy other goods or services during your tour, those are not part of the package we provide, even if arranged through our tour leader. Accordingly, we are not liable to you for any happening in connection with that service or those goods. 

20.0 Participation & Behaviour 

20.1 Most Bushido Travel Pty Ltd tours require reasonable physical fitness and appropriate footwear. You should be prepared to walk between 10 and 15 thousand steps a day, sometimes on uneven or slippery surfaces.

20.2 To satisfy the majority of our clients, we apply “no smoking” rules in the same way that they are applied by law in Australia. Please note however, that smoking is permitted in some countries we may visit so we cannot prevent third parties from smoking in a bar or restaurant.

20.3 If we provide medical help to you, if needed, whether or not you specifically ask for it, we will provide receipts for all costs (for your insurer) and you now agree to repay us that cost on your return from the tour.

20.4 If at any time, a complaint (given by any of our staff or tour leaders) that you are acting in a way which may cause accident, injury, discomfort or extreme displeasure to any other tour member or members of the host country, may result in exclusion from the programme for the remainder of the tour.

20.5 Any form of inappropriate conduct both written, verbal and in person, will not be tolerated. This conduct includes (but not limited to) any type of bullying, intimidation, abuse (direct and in-direct), racist or derogative comments or disrespect towards anyone. Any instance of this inappropriate conduct may result in exclusion from the programme for the remainder of the tour.

21.0 Complaints 

21.1 We shall try our utmost to provide a happy and fulfilling tour, but if we fail in any way, you must raise any issue with your tour leader immediately. If your complaint cannot be satisfied, or it is not dealt with to your satisfaction at the time of reporting it to the leader(s), then you should provide full details in writing, to info@bushidotravel.com.au immediately or as soon as possible and within 7 days of the completion of the tour. Any complaint must be factual and respectful. No derogative or defamatory complaints will be entertained. We will try and resolve any complaints, through discussion and/or mediation as soon as possible. 

21.2 The validity, construction and performance of this agreement shall be governed by the laws of the State of South Australia. Any dispute arising in connection with this agreement shall be subject to the exclusive jurisdiction of the South Australian courts.
